References to "we", "us", or "the seller" mean the operator above. By purchasing or making a patronage payment, you agree to these terms.

We sell digital wallpaper packs, high-resolution art print files, and simple personal video commissions. Existing video artworks are not sold as video downloads. Physical goods are not available for purchase.

One-time and monthly patronage payments help the artist continue making work. They are not purchases of exclusive content, memberships, downloads, or access. All patronage levels offer the same thing: patronage for the work. No rewards, publication schedule, future benefits, or delivery date are guaranteed.

Monthly patronage renews automatically at the selected amount until cancelled. You can cancel future renewals at any time through the Stripe Customer Portal linked from the patronage page. Cancellation does not retroactively refund payments already completed.

All product prices and patronage amounts are in EUR. The seller currently applies the Italian regime forfettario, so Italian VAT is not charged under Article 1, paragraphs 54–89 of Law 190/2014. Payment is processed by Stripe Checkout; we never see or store your card details. The Stripe receipt confirms payment but is not an Italian fiscal invoice. If you need an invoice, email a@smetanka.me before paying so that we can collect the required billing details.

Ready wallpaper packs are made available through a private link sent to your checkout email after payment is confirmed. Wallpaper preorders are prepared manually before that link is sent. Hi-res print files are prepared and emailed within a few days. For a personal video, we agree the brief by email and deliver within 14 days of brief approval. See the Delivery page for details.

Products marked as preorder are prepared after purchase. Preparation begins as soon as your order is placed. Timing is listed on the product page. See §7 for your right to cancel a preorder before it is delivered.

The €250 simple commission includes a video of up to 20 seconds, one scene, one delivery format, and one minor revision, without music. The purchased artwork is a new personal commission, not a copy or purchase of the selected reference video.

We agree the direction before production. Complex projects, commercial use, exclusive rights, and music require a separate quote and are not included in this purchase. Music by Wayves is available only by separate agreement covering the intended use.

If we cannot agree a brief within the purchased scope, we refund the payment before production. Physical goods remain unavailable.

For wallpaper packs, before paid checkout you actively request delivery during the 14-day withdrawal period and acknowledge that your right of withdrawal ends when you open the private download page or start downloading. This consent is never selected for you and is recorded with the order.

For wallpaper packs, until you begin the download you may withdraw without giving a reason within 14 days of purchase. Wallpaper preorders may also be cancelled before the private download link is sent. Opening the private download page or starting a download begins supply; from that point the statutory withdrawal right ends under Article 59(o) of the Italian Consumer Code.

For hi-res files and personal video commissions, we allow cancellation and a full refund within 14 days of purchase, including if preparation has begun or the file has been delivered. Email a@smetanka.me with your receipt. After a refund, the license ends and you must stop using the file. Statutory remedies for defective or non-conforming content remain unaffected.

Buying a file gives you a personal, non-commercial license:

– You may use wallpapers on your own devices.

– Hi-res print files include permission to print the selected artwork for your own space. You may not print wallpapers, previews, or screenshots.

– Personal video commissions are for personal, non-commercial use; commercial or exclusive rights are not included.

– You may share the imagery on social media with credit (@asmetanka).

– You may not resell, redistribute, sublicense, mint as NFTs, use commercially, or use the files to train AI models.

All artwork, videos, stills, and product imagery remain the intellectual property of the artist. A purchase transfers the license described here, not copyright. For commercial licensing, write to a@smetanka.me.

The works are original artworks created by the artist using generative image and video systems as part of the production method. What you buy is a finished artwork file, not an automated generation service.

You may not use this site or your purchases for unlawful purposes, and you may not misrepresent the authorship of the works. We may refuse service in cases of fraud or abuse.

Nothing in these terms limits liability that cannot be limited by law, including your statutory consumer rights. Otherwise, our total liability in connection with any order is limited to the amount you paid for that order.

These terms are governed by Italian law, without prejudice to any mandatory consumer protections of your country of residence. If a problem comes up, contact us first at a@smetanka.me — genuine issues are resolved quickly. EU consumers may also use out-of-court dispute resolution bodies available in their country of residence.

We may update these terms. The version published at the time of your purchase applies to your order.
